These Terms and Conditions (“Terms”) govern your access to and use of the CloudNestin website, products, software, AI-powered services, digital content, and any related services provided by CLOUDNESTIN SYSTEMS LTD (Company Number: 15459793) (“CloudNestin”, “Company”, “we”, “our”, or “us”).
By accessing the website, creating an account, topping up your wallet, purchasing digital products, or using any CloudNestin services, you agree to be legally bound by these Terms.
If you do not agree with these Terms, you must not use our website or services.
CloudNestin is an online platform providing AI-powered digital tools and educational digital products, including but not limited to:

AI Creative Tools
Educational video courses
Downloadable digital content
All products and services available through CloudNestin are supplied exclusively in digital form.
No physical goods are sold or delivered.
You must be at least eighteen (18) years old to create an account, purchase products, top up a wallet, or otherwise use paid services.
By using CloudNestin, you represent and warrant that:
you are at least 18 years old;
you have legal capacity to enter into binding contracts;
all information you provide is accurate and complete.
Certain services require registration.
You agree to:
provide accurate information;
maintain the security of your account;
keep your password confidential;
immediately notify us of unauthorized use;
accept responsibility for all activity occurring under your account.
We may suspend or terminate accounts where fraud, abuse, illegal activity, payment disputes, or violations of these Terms are detected.
Certain CloudNestin services require customers to purchase Points before accessing AI tools or other eligible digital services.
Points are digital units that may be purchased and used solely within the CloudNestin platform to access eligible services and digital products, including AI-generated content.
Points:
are not electronic money;
do not represent a bank deposit or stored monetary value;
have no monetary or cash value outside the CloudNestin platform;
cannot be redeemed or withdrawn for cash;
cannot be exchanged for legal tender or cryptocurrency;
cannot be transferred between users;
cannot be sold, traded, or assigned;
may only be used to purchase eligible products and services offered through CloudNestin.
Customers may buy Points to their account using the payment methods made available on the platform. Purchased Points are added to the customer’s account and remain available until used for eligible CloudNestin products or services.
Points cannot be withdrawn to a bank account, payment card, payment provider, cryptocurrency wallet, or any other external account.
Unless otherwise required by applicable law or expressly approved by CloudNestin, purchases of Points and unused Points are non-refundable.
CloudNestin reserves the right to suspend, adjust, or remove Points associated with fraudulent transactions, abuse, payment reversals, chargebacks, refunds, or technical errors.
Payments for Points are processed by independent third-party payment service providers.
CloudNestin does not store complete payment card information.
CloudNestin may allow customers to browse and pay in multiple supported currencies.
Currency conversion rates are calculated using periodically updated exchange rates together with applicable payment processing costs, rounding adjustments, and other operational factors.
The final amount payable is displayed before payment confirmation.
Customers remain solely responsible for any fees charged by their bank, payment provider or card issuer relating to foreign exchange or currency conversion.
MAKE SURE YOU UNDERSTAND THE COSTS OF CURRENCY CONVERSION AS THEY MAY BE DIFFERENT DEPENDING ON WHETHER YOU SELECT YOUR HOME CURRENCY OR THE TRANSACTION CURRENCY.
CloudNestin may, from time to time, offer promotional codes, discount codes, coupons or special offers.
Unless otherwise expressly stated:
promotional codes are valid only during the published validity period;
only one promotional code may be used per eligible transaction;
promotional codes cannot be exchanged for cash;
promotional codes cannot be transferred;
promotional codes cannot be combined unless expressly permitted;
promotional codes apply only to eligible products or services.
If a purchase made using a promotional code is refunded, only the amount actually paid by the customer may be refunded.
CloudNestin reserves the right to modify, suspend, withdraw or cancel any promotional offer at any time in cases including fraud, abuse, technical error or legal compliance.
All CloudNestin products are delivered electronically.
Products may include:
downloadable files;
PDFs;
images;
AI-generated content;
educational videos;
streaming content;
downloadable course materials.
Delivery normally occurs immediately following successful payment or completion of content generation.
No physical products are supplied.
CloudNestin provides automated AI-powered services.
Generated content is created entirely by automated systems based upon information supplied by users.
By using our AI services you acknowledge that:
outputs may differ from expectations;
AI responses are automatically generated;
outputs may contain inaccuracies;
creative results are subjective;
generated content is considered delivered once made available within your account.
CloudNestin does not guarantee that AI-generated content will meet every user’s subjective expectations.
Transactions processed through CloudNestin may appear on your payment card statement using the billing descriptor:

Customers should retain transaction confirmations and invoices for their records.
All intellectual property rights relating to the CloudNestin website, software, AI systems, digital tools, text, graphics, logos, icons, videos, downloadable materials, databases, and other content are owned by or licensed to CLOUDNESTIN SYSTEMS LTD and are protected by applicable intellectual property laws.
Subject to these Terms, CloudNestin grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services solely for your personal, non-commercial use.
You may not:
copy, reproduce, distribute, publish, transmit, display or sell any part of the Services;
modify or create derivative works based upon our Services;
reverse engineer, decompile or attempt to extract source code from any software or AI systems;
use any automated tools to scrape or harvest content;
remove copyright or proprietary notices;
use our trademarks without prior written permission.
You remain responsible for all information, prompts, images, files and other content you submit to CloudNestin.
You represent and warrant that your submitted content:
does not violate any law;
does not infringe intellectual property rights;
is not defamatory, abusive, obscene or unlawful;
does not contain malicious software or harmful code.
You grant CloudNestin a limited licence to process such content solely for providing the requested Services.
CloudNestin does not claim ownership of your uploaded content.
You agree not to:
use the Services for unlawful purposes;
abuse, overload or interfere with our systems;
attempt to bypass payment mechanisms or wallet restrictions;
exploit software vulnerabilities;
use bots or automated systems to misuse our Services;
resell access to paid Services;
impersonate another person;
upload viruses, malware or harmful files;
engage in fraudulent payment activity;
attempt unauthorized access to other user accounts.
Violation of these Terms may result in immediate suspension or permanent termination of your account.
Refunds are governed by our Refund & Returns Policy, which forms an integral part of these Terms.
In summary:
digital products are non-returnable once delivered;
AI-generated content is considered delivered immediately after generation;
wallet top-ups purchase non-refundable virtual credits;
educational courses become non-refundable once accessed;
refunds may be available only where required by law or in cases of verified technical failure or duplicate payment.
CloudNestin may suspend or terminate your account without prior notice if:
these Terms are breached;
fraudulent activity is detected;
payment fraud or chargebacks occur;
misuse of AI systems is identified;
legal or regulatory requirements require suspension;
continued access poses security risks.
Termination shall not affect any rights or obligations that accrued before termination.
CloudNestin provides its Services on an “AS IS” and “AS AVAILABLE” basis.
To the fullest extent permitted by law, we make no warranties or representations regarding:
uninterrupted availability;
error-free operation;
compatibility with every device;
uninterrupted access to AI services;
merchantability;
fitness for a particular purpose;
accuracy or completeness of AI-generated content.
Generated content should not be relied upon as professional, medical, legal, financial or educational advice.
To the fullest extent permitted by applicable law, CLOUDNESTIN SYSTEMS LTD shall not be liable for:
indirect damages;
incidental damages;
consequential damages;
loss of profits;
loss of revenue;
loss of goodwill;
business interruption;
loss of data;
dissatisfaction with AI-generated output.
Where liability cannot legally be excluded, our maximum aggregate liability shall not exceed the amount actually paid by you to CloudNestin during the twelve (12) months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes liability where exclusion is prohibited by law.
You agree to indemnify, defend and hold harmless CLOUDNESTIN SYSTEMS LTD, its directors, employees, contractors and affiliates from any claims, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of:
your use of the Services;
your violation of these Terms;
your uploaded content;
your infringement of third-party rights.
Your use of the Services is also governed by our Privacy Policy.
By using CloudNestin you acknowledge that your personal information will be processed in accordance with that Privacy Policy.
CloudNestin reserves the right to modify these Terms at any time.
Updated versions become effective immediately upon publication unless otherwise stated.
Your continued use of the Services after publication constitutes acceptance of the revised Terms.
These Terms and any dispute arising out of or relating to the Services shall be governed by the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction unless otherwise required by applicable consumer protection laws.
